When the property you have loaned money against is damaged, your security is impaired in more than one way!

If The Property Owner Does Not Get All Benefits To Which He/She Is Entitled:

  1. The borrower won't have the proceeds, to which they are entitled, to repair all the damage.
  2. It may make it more difficult for them to:
    • Refinance the property.
    • Insure the property again.
    • Sell the property for an acceptable price.

Each of these circumstances increases your risk.

If the damage is not fully repaired and you are forced to take the property back, the property may be worth less, often significantly less, than you thought it was. You will be at additional risk.

If there was money owed to pay for the repairs that was not paid, you and the borrowers lose and the reponsible party(ies) or insurance company(ies) get a windfall. It (they) gets to keep money that belongs to the borrower and protects the security for your loan.

In many cases a lender may have no claim to the proceeds owed by the reponsible party(ies) or insurance company(ies) because of a particular type of damage. If the owner doesn't perfect the claim, both you and the owner can be out of luck.

In other cases the lender may be able to recover even if the borrower has done or failed to do something which permits the the reponsible party(ies) or insurance company(ies) to deny an otherwise valid claim. If you wait too long or are not adequately represented, the benefits will still be lost.

If you are not aware of the problem or don't tell your clients, most of them may not find out they have been damaged until it is too late.

If you are aware of the problem and do tell them and they save tens or hundreds of thousands of dollars because of you - that will be good for them and good for your business.
